Arbitral Decisions

One must often use their best detective skills to locate a decision or award issued by an international arbitral tribunal.

  • Many decisions are not published, or are only available in abstract format. 
  • Some appear behind paywalls.
  • Finally, commercial publishers may select only a few decisions to publish, with a focus on particular types of disputes or those appearing before a specific arbitration institution. 

Key Tips:

  • Mine the footnotes of law review articles and Treatises
  • Consult multiple sources 
  • Search by Institution or Treaty provision

 

Specialized Databases: Westlaw & ICC

Westlaw has a specialized set of resources on International Arbitration

ICC Dispute Resolution Library

  • Jus Mundi has partnered with the ICC to provide the ICC Dispute Resolution Library
  • Some portions are freely available, while other resources are behind paywalls. 
  • You may search for awards, commentaries, reports, rules and articles. 
  • In the free version, you may find abstracts of some procedural orders.

Specialized Arbitration Journals

  • The American Review of International Arbitration.  Available online.
    Quarterly journal publishes scholarly articles, commentary, and case notes on arbitrations throughout the world. 

     
  • Arbitration International.  Available online (1996-present).
    Quarterly publication features articles written by practitioners and scholars, case notes, and book reviews.

     
  • European Investment Law & Arbitration Review. Available HeinOnline. Full text: Vols. 1-4 (2016-2019); Indexed only: Vols. 1-7 (2016-2022). 
    This journal publishes articles on topics related to both international commercial arbitration and international investment arbitration. Articles typically include excerpts from recent arbitral awards or court decisions, along with substantive commentary. 

     
  • Global Arbitration Review.  Some availability HeinOnline.
    Practitioner-oriented bi-monthly journal focusing on current developments and trends in international commercial arbitration and investor-state arbitration.  Includes summaries of recent arbitral awards and courts decisions.
    • The public facing Global Arbitration Review permits you to search recent news stories related to international arbitration. Even without a subscription, you can identify pending topics and current events by associated headlines.  

  • ICC International Court of Arbitration Bulletin.  
    This official ICC publication includes practitioner-written articles in English, as well as extracts from significant arbitration awards issued under the ICC's arbitration rules. 

     
  • International Arbitration Law Review. 
    Includes summaries of arbitration cases from around the world, expert commentary, and news about legislative developments and court decisions.  

     
  • Journal of International Arbitration. K10.0769. (Print, 1984 - 2010). Articles after that date may be obtained via ILL.
    Bi-monthly journal focusing on the economic aspects of arbitration.

  •  World Arbitration & Mediation Review. K2400.A13 W7 (in print).
    This quarterly journal, written by experienced practitioners, is available only in print.
